The Administrative Council for Economic Defense (Cade) approved, in the judgment session this Wednesday (21/11), 16 Terms of Cessation Commitment (TCCs) in six cartel investigations related to the "lava-jato" operation.
The agreements were signed by Carioca Christiani-Nielsen Engenharia, Odebrecht, OAS and Andrade Gutierrez, as well as employees and former employees linked to the companies. Through the terms of cessation, the payment of pecuniary contributions totaling R$897.9 million was established, to be collected to the Fund for the Defense of Diffuse Rights (FDD) of the Ministry of Justice.
The agreements also require them to B2B Lead recognize their participation in the cartel and to collaborate effectively with investigations still underway at the municipality. The signing of the agreement suspends the processes in relation to the collaborating companies, but does not end the investigations of other cases not specifically involved in the TCCs.
Cade's president, Alexandre Barreto, highlighted that the signing of the agreements is part of a broader process, which involves all bodies that investigate, in close cooperation, the "lava jet" cases.
Petrobras engineering services
The companies OAS, Carioca and Odebrecht each signed a TCC in the administrative process that investigates the formation of a cartel in public tenders conducted by Petrobras for contracting onshore engineering, construction and industrial assembly services .
The agreement with OAS provides for the payment of R$124,710,743.26 (including individuals). The agreement signed with Carioca Engenharia establishes a pecuniary contribution of R$54,168,407.61 (including individuals). Odebrecht was determined to have a value of R$338,984,697.80 (including individuals).
The case began with the signing, in March 2015, of a leniency agreement with Setal Engenharia e Construções, SOG Óleo e Gás and individuals related to the group.
As part of this process, a TCC had already been signed with Andrade Gutierrez, approved in 2017. Among the obligations, the payment of contributions of R$ 49,854,412.72 was foreseen.
In relation to UTC Engenharia, which signed an agreement in the same period, Cade declared full non-compliance with the TCC as the pecuniary contribution was not paid within the established deadline.
Angra 3 Plant
The construction company Odebrecht signed a TCC in the process that investigates cartel practices in public bidding for the Angra 3 plant, promoted by Eletrobrás Termonuclear (Eletronuclear), through which it committed to paying R$ 13,883,074.54 as a contribution pecuniary. The amount corresponds to the sum of the values established for the company and related individuals.
The investigation began in July 2015, after signing a leniency agreement with Construções e Comércio Camargo Correa, employees and former employees of the company.
